OFFICIAL COMPETITION RULES
These “Official Competition Rules” govern your participation in the Ministry of Sound Recordings Limited (“MOS”) “Michael Woods - #WOJB Instagram Competition” (the “Competition”). Participation in the Competition by submitting your name and email address (as per the instructions below) constitutes your full and unconditional agreement to and acceptance of these Official Competition Rules. It is important that you read and understand them.
1. Who Is Eligible?
The Competition is open to residents in the UK and Eire. Only persons who are at least eighteen (18) years old are eligible to enter the Competition. Any person who is an employee of MOS or an immediate family member of an employee of MOS or any other person who is directly connected with MOS, being any advertising promotion agency or supplier of the Prize (as defined below) for the Competition, shall be ineligible to enter.
2. How To Enter
(a) To enter the Competition go to the official Michael Woods website at http://michaelwoods.typepad.com/ (the “Competition Page”) and follow the directions to enter. The Competition is open between 05:00 pm BST on 11 October 2012, and 23:59 am BST on 28 October 2012 (the “Competition Term”). You are responsible for all internet and all other costs incurred by you in submitting your entry to the Competition.
(b) In order to participate in the Competition you must follow the instructions and upload a photograph of yourself doing one of the gymnastic moves from Michael Woods’ official video for “We Have Only Just Begun” and tag it with the hash tag “#WOJB” (the “Entry”). Please make sure that before you upload the photograph, your Instagram settings are set to “Public” or we will not receive a notification of your Entry.
(c) Entries must not be obscene or defamatory in any way.
(d) Entrants will retain copyright in their submitted entries, however, by entering, you grant to MOS a worldwide royalty-free perpetual licence and your consent in relation to your image rights to use the Entry in any and all media (including print and online) in connection with the Competition.
(d) You may enter the Competition only once. By entering, you agree to be bound by MOS’s selection process which will as described below. MOS shall not take any responsibility for any entries which are illegible, misdirected, lost for technical or other reasons or received after the Competition Term.
3. Information about You
You warrant that:
(a) you meet the entry requirements for the Competition;
(b) you confirm that MOS shall have the right to use your Entry, name and likeness in connection with the Entry and the promotion of the Competition; and
(c) you shall fully and effectually indemnify MOS in respect of any breach of your warranties, obligations or representations made herein together with MOS’s reasonable legal costs.
4. Prize
(a) After the Closing Date, Michael Woods will choose the winner by selecting his favourite photograph from all the Entries (the “Winner”). Michael Woods’ decision is final and binding on entrants.
(b) Prize for the Winner:
- 2 VIP tickets to see Michael Woods live at the party hosted at the Ministry of Sound club in London on the 21st December 2012 at 19:00 pm BST (the “Prize”); and
- 2 Return Economy class train tickets from the nearest national line train station to the place of residence of the Winner to London (subject to the train provider terms and conditions).
- 1 night accommodation at and hotel in London to be chosen by MOS in its discretion for two in one room (twin/double) on a room-only basis (subject to accommodation provider’s terms and conditions).
(c) The Winner will be selected on the 29 October 2012 after 10:00 am GMT (the “Closing Date”). Michael Woods’ (or its representatives’) decision on behalf of MOS shall be final and binding in all regards and no correspondence shall be entered into.
(d) The Winner will be announced by MOS by uploading the Entry of the Winner on Michal Woods’ social networks (facebook and twitter). MOS will then contact the Winner to obtain their full name and a valid email address and the full name of the person to whom they want to give one of the two tickets forming the Price (the “Guest”). The Guest must be aged 18 or above. MOS will also send to the Winner a confirmation via email with details of their Prize. If a Winner cannot be contacted within twenty-four (24) hours of first notification attempt, or in the event that the original Winner transpires to have breached these Official Competition Rules, MOS may draw at random an alternative Winner from the participants who entered an Entry. The name of the Winner will be available on request.
(e) the Prize is non-transferable. MOS does not make any warranty about the Prize and there are no substitutions or cash redemptions for the Prize. MOS further reserves the right to substitute the Prize at any time to a value it deems appropriate.
(f) if, for reasons beyond the control of MOS (including, but not limited to, tampering or computer virus infection or rights issues), the Competition is not capable of running as originally planned, MOS at their sole discretion, reserve the right to cancel or modify the Competition, without liability. If a sufficient number of eligible entries (as determined by MOS in its sole discretion) are not received by the Closing Date, MOS reserves the right not to award the Prize. All taxes levied on the Prize awarded in the Competition (including, but not limited to, income taxes) are the sole responsibility of the Winner. All entrants agree to comply fully with each provision in these Official Competition Rules. Any person attempting to defraud or in any way tamper with this Competition and any person who does not comply with these Official Competition Rules, will be ineligible for the Prize and may be prosecuted to the full extent of the law. No cash alternative to the Prize is available to the Winner. If the Winner of the Prize cannot be traced after reasonable efforts having been made by MOS then MOS may dispose of the Prize as it thinks fit without any liability to the Winner for having done so.
5. Your Release of MOS from Any and All Liability.
MOS shall not be liable for losses or injuries of any kind resulting from: (i) acceptance/possession and/or use/misuse of the Prize/loss or damage to the Prize during delivery to the Winner, (ii) participation in the Competition, (iii) individual, joint or collective technical malfunctions of the telephone network and/or transmission line, internet connections, computer equipment, hardware and/or software, or (iv) any delay or distortion of an entry resulting from data transmissions that are garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Competition Rules. MOS shall not be liable for damage to your computer (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to your participation in the Competition or downloading of information in connection with the Competition. MOS reserves the right to modify or cancel the Competition in the event that any portion of any website used to administer any aspect of the Competition becomes technically corrupted. (v) the Winner and the Guest shall be solely responsible for the following: a) their transport from and to the train station, the hotel and the Ministry of Sound club in London; b) their food and drinks; c) their travel insurance (if any); e) their ability to provide a valid ID proving that they are aged eighteen (18) or above.
6. Law
These terms and conditions are governed by English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
