OFFICIAL COMPETITION RULES
These “Official Competition Rules” govern your participation in the Ministry of Sound Group Limited (“MOS”) “Win a chance to feature in our new Addicted to Bass 2014 Advert” (the “Competition”). Participation in the Competition by sending a tweet on Twitter (as per the instructions below) constitutes your full and unconditional agreement to and acceptance of these Official Competition Rules. It is important that you read and understand them.
1. Entry Requirements
The Competition is open to residents in the UK and Eire. Only persons who are at least eighteen (18) years old are eligible to enter the Competition. Any person who is an employee of MOS or an immediate family member of an employee of MOS or any other person who is directly connected with MOS, being any advertising promotion agency or supplier of the Prize (as defined below) for the Competition, shall be ineligible to enter.
2. How To Enter
(a) To enter the Competition go to the following page www.twitter.com/ministryofsound (the “Competition Page”) and follow the directions to enter. The Competition is open between 23:59 GMT on 24 February 2014, and 12:00 GMT on 7 March 2014 (the “Competition Term”). You are responsible for all internet and all other costs incurred by you in submitting your entry to the Competition.
(b) In order to participate in the Competition you must follow the instructions and tweet a photograph of yourself to #BassInYourFace on Twitter (the “Entry”).
(c) Entries must not be obscene or defamatory in any way.
(d) Entrants will retain copyright in their submitted entries, however, by entering, you grant to MOS a worldwide royalty-free perpetual licence and your consent to use the Entry in any and all media (including print and online) in connection with the Competition.
(d) You may enter the Competition only once. By entering, you agree to be bound by MOS’s selection process as described below. MOS shall not take any responsibility for any Entries which are illegible, misdirected, lost for technical or other reasons or received after the Competition Term.
3. Information about You
You warrant that:
(a) you meet the entry requirements for the Competition;
(b) you confirm that MOS shall have the right to use your Entry, name and likeness in connection with the promotion of the Competition; and
(c) you shall fully and effectually indemnify MOS in respect of any breach of your warranties, obligations or representations made herein together with MOS’s reasonable legal costs.
(a) After the Closing Date, Eddie Craig and Jim Sullivan together professionally known as the ‘Wideboys’ (“Wideboys”) will choose the winner by selecting their favourite photograph from all the Entries (the “Winner”). The Wideboys decision is final and binding on entrants.
(b) Prize for the Winner:
- appearance in the ‘Addicted to Bass 2014’ TV advertisement to be shoot on 11 March 2014 in London (the “Performance”); and
- one (1) copy of the ‘Addicted to Bass 2014’ compilation album.
(c) The Winner will be selected on 7 March 2014 after 16:00 GMT (the “Closing Date”). The Wideboys (or their representatives’) decision on behalf of the Wideboys shall be final and binding in all regards and no correspondence shall be entered into.
(d) The Winner will be announced by MOS and/or the Wideboys directly on Twitter. MOS will contact the Winner by sending them a private message on Twitter to obtain their full name and a valid email address and once MOS receives them, MOS will also send to the Winner a confirmation via email with details of their Prizes. If a Winner cannot be contacted within twelve (12) hours of first notification attempt, or in the event that the original Winner transpires to have breached these Official Competition Rules, MOS may chose at random an alternative Winner from the participants who entered an Entry. The name of the Winner will be available on request.
(e) The Prizes are non-transferable. MOS does not make any warranty about the Prizes and there are no substitutions or cash redemptions for the Prizes. MOS further reserves the right to substitute the Prizes at any time to a value it deems appropriate.
(f) If, for reasons beyond the control of MOS (including, but not limited to, tampering or computer virus infection or rights issues), the Competition is not capable of running as originally planned, MOS at its sole discretion, reserves the right to cancel or modify the Competition, without liability. If a sufficient number of eligible entries (as determined by MOS in its sole discretion) are not received by the Closing Date, MOS reserves the right not to award the Prizes. All taxes levied on the Prizes awarded in the Competition (including, but not limited to, income taxes) are the sole responsibility of the Winner. Any person attempting to defraud or in any way tamper with this Competition and any person who does not comply with these Official Competition Rules, will be ineligible for the Prizes and may be prosecuted to the full extent of the law. If the Winner of the Prizes cannot be traced after reasonable efforts having been made by MOS then MOS may dispose of the Prize as it thinks fit without any liability to the Winner for having done so.
(a) The Winner shall be at least eighteen (18) years of age to participate in the Performance.
(b) The Winner shall attend the Performance on 11 March 2013 (or at such other dates as notified by MOS) times and locations as requested by MOS.
(c) The Winner shall execute a Performance Release Form upon MOS’ request in respects of their Performance.
(d) The Winner warrants that their Performance will not be in any way obscene or defamatory.
(e) The Winner will indemnify and hold MOS harmless from and against any and all loss damage costs and expenses including reasonable legal fees arising out of or by reason of any breach by the Winner of the representations and/or warranties made by the Winner in these Official Competition Rules.
5. Your Release of MOS from Any and All Liability.
(a) MOS shall not be liable for losses or injuries of any kind resulting from: (i) acceptance/possession and/or use/misuse of the Prizes/loss or damage to the Prizes during delivery to the Winner; (ii) participation in the Competition; (iii) the Winner participation in ‘Addicted to Bass 2014’ TV Advertisement provided that nothing in this clause 5 shall exclude MOS’ liability for death and/or personal injury. (iv) individual, joint or collective technical malfunctions of the telephone network and/or transmission line, internet connections, computer equipment, hardware and/or software; or (v) any delay or distortion of an entry resulting from data transmissions that are garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Competition Rules. MOS shall not be liable for damage to your computer (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to your participation in the Competition or downloading of information in connection with the Competition. MOS reserves the right to modify or cancel the Competition in the event that any portion of any website used to administer any aspect of the Competition becomes technically corrupted;
(b) The Winner and Guests shall be solely responsible for arranging their travel to the location where the Performance will take place. The Winner may be required to provide a valid ID prior to delivering his Performance.
These terms and conditions are governed by English law and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
